1. Provider Information

These Terms of Service and End User License Agreement govern your access to and use of Mendro on the web, in the app, and in related services. The provider is Dennis Zink, operating as Mendro, Im Bannhölzle 10, 72160 Horb am Neckar, Germany. Contact: support@mendro.ai.

2. Acceptance and Contract Scope

By creating an account, downloading the app, accessing the website, or using Mendro, you agree to these Terms and our Privacy Policy. If you use Mendro through the Apple App Store, the Apple-specific terms in these Terms also apply. If you do not agree, you must not use the service.

3. Eligibility, Age and Safety Boundaries

You must be old enough to form a binding contract in your country and at least 16 years old to use the service. Mendro is not directed to children. The service is intended for reflective self-use and is not suitable as an emergency, crisis, or acute mental-health intervention service. By using Mendro, you confirm that you meet these requirements and will seek qualified emergency or professional help where needed.

4. Service Scope and Medical Disclaimer

Mendro provides AI-assisted self-reflection, journaling, pattern recognition, prompts, and related features designed to help users think more clearly about their own experiences. The service is a self-reflection and mental wellness support tool only. It does not provide medical advice and does not replace diagnosis, treatment, psychotherapy, psychiatric care, or crisis intervention.

5. Accounts and Security

You must provide accurate information, keep your credentials confidential, and are responsible for activity under your account unless caused by our breach. You must notify us without undue delay if you believe your account has been accessed without authorization.

6. User Content and Service License

You retain your rights in the content you submit to Mendro, including journal entries, prompts, reflections, and other inputs. You grant us a limited, non-exclusive right to host, process, transmit, reproduce, and format that content solely as needed to operate, secure, improve, and support the service for you and to comply with legal obligations. We do not acquire ownership of your content.

7. AI-Specific Terms

Mendro uses automated systems and AI models to support reflection. AI-generated outputs may be incomplete, inaccurate, biased, or unsuitable for your circumstances. They are supportive tools, not professional judgments or binding recommendations. Mendro does not make decisions for you. You remain responsible for how you interpret, rely on, or act on any output from the service.

8. Acceptable Use and Safety Restrictions

You must not misuse the service. This includes violating law, infringing others' rights, attempting unauthorized access, interfering with security, submitting malicious code, automating abusive usage, using the service to exploit or harm others, or using Mendro in a way that creates unreasonable safety, fraud, or compliance risk. We may apply safety measures, usage limits, content restrictions, or account restrictions where reasonably necessary.

9. Purchases, Subscriptions and Withdrawal

Subscriptions and in-app purchases are processed by Apple App Store or Google Play where applicable. Pricing, billing periods, auto-renewal, cancellation timing, refunds, restore flows, and payment handling follow the rules and purchase flows of the store through which you subscribe. Links to these Terms of Use and our Privacy Policy are available in the app and on our website. If you request immediate performance of digital services, statutory withdrawal rights may be limited or lost to the extent permitted by applicable law. Website offers, if introduced, may be subject to separate checkout terms presented at purchase.

10. Third-Party Services and Terms

Mendro may depend on third-party platforms, app stores, hosting, analytics, payment, and AI providers. Your use of certain features may also be subject to third-party terms that apply to your device, operating system, carrier, app store, or payment provider. You must comply with those third-party terms when using the service.

11. Privacy and Processors

We process personal data as described in our Privacy Policy. Core processors and recipient categories used by the service can include:

hosting and infrastructure providers
authentication, database, and storage providers
AI processing providers used to generate product responses and structure reflection content
app stores and subscription infrastructure
analytics providers where you have opted in
support, email, legal, compliance, and security providers

12. Suspension and Termination

You may stop using the service and delete your account at any time. We may suspend, restrict, or terminate access where reasonably necessary for safety, misuse prevention, security, payment issues, legal compliance, or serious or repeated breaches of these Terms. Data handling after termination follows the Privacy Policy and any mandatory legal retention obligations.

13. Warranties and Service Availability

Except where warranties cannot lawfully be excluded or limited, Mendro is provided on an as-available basis. We do not promise uninterrupted availability, error-free operation, or that every output will be accurate or fit for a particular purpose. Nothing in these Terms limits any mandatory statutory rights you may have as a consumer.

14. Liability

Nothing in these Terms excludes or limits liability where exclusion is prohibited by law, including intent, gross negligence, injury to life, body, or health, mandatory product liability, or mandatory consumer rights. For breaches of essential contractual obligations, liability is limited to foreseeable damage typical for the contract, except where stricter liability applies by law. Otherwise, liability is excluded to the maximum extent permitted by law.

15. Governing Law and Consumer Protections

These Terms are governed by German law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, mandatory consumer protection rules of your country of habitual residence remain unaffected. Jurisdiction rules apply only to the extent they can lawfully be agreed.

16. Changes to the Terms

We may update these Terms for legal, regulatory, security, technical, or product reasons. If a change materially affects your rights or obligations, we will provide notice before it takes effect by appropriate means such as in-app notice, website publication, or email where appropriate. The current version is available in-app and at https://www.mendro.ai/en/terms.

17. Apple App Store Additional Terms

This section applies only if you obtained Mendro through the Apple App Store. The license for the iOS application is concluded between you and Dennis Zink, operating as Mendro, not with Apple. Apple is not responsible for the app or its content. We grant you a personal, non-transferable license to use the app on Apple-branded products that you own or control, subject to the applicable Apple usage rules, including Family Sharing or similar access rights where Apple makes them available. Apple has no obligation to provide maintenance or support for the app. To the maximum extent permitted by law, Apple has no warranty obligation for the app. If the app fails to conform to an applicable warranty, you may notify Apple and Apple may refund the purchase price paid for the app, if any. To the maximum extent permitted by law, Apple will have no further warranty obligation with respect to the app.

18. Apple Claims, Compliance and Third-Party Beneficiary

Dennis Zink, operating as Mendro, not Apple, is responsible for addressing claims relating to the app, including product liability claims, claims that the app does not comply with legal or regulatory requirements, and claims under consumer protection, privacy, or similar laws. If a third party claims that the app or your possession and use of it infringes intellectual property rights, Dennis Zink, operating as Mendro, not Apple, is responsible for investigating, defending, settling, and discharging that claim. You represent that you are not located in a country subject to a U.S. embargo and are not on a U.S. government list of prohibited or restricted parties. Apple and Apple's subsidiaries are third-party beneficiaries of the Apple-specific terms in these Terms and may enforce them against you once you accept these Terms.
